June 24 Toronto John Damien was granted an appeal for reinclusion of major claims in his suit against the Ontario Racing Commission. Reversing Justice S.M. McBride's decision of June 11, Justice J. Lerner restored two important parts of Damien's claim — that he had been fired because he was a homosexual, and that he had been competent in his former position as a steward for the Ontario Racing Commission.
