May 13 Toronto The lawyer for John Mooney, president of the Ontario Jockey Club, asked Justice S.M. McBride of the Supreme Court of Ontario to dismiss several parts of John Damien's statement of claim against him, including the allegation that Mooney was motivated by prejudice against Damien's sexual orientation. On June 11, Justice McBride ruled that portions of the claim that alleged anti-gay prejudice be struck out. Damien's lawyers immediately appealed the decision. (see also June 24,1975.)
