October 14 Toronto Justice Thomas Zuber and two other justices of the Ontario Court of Appeal overturned the reinstatement of gay OPP officer Paul Head, stating that Head had failed to prove that his resignation in March 1978 was made under duress and coercion and was not truly voluntary. Head appealed the decision to the Supreme Court of Canada, which heard the case on April 29, 1985, and ruled to dismiss it on May 9, 1985, stating there was no basis for judicial review.
